Welcome to The Morrow Market. These Terms & Conditions (“Terms”) govern your use of www.themorrowmarket.com and our services (the “Service”). By creating an account, placing an order, or listing products as a vendor, you agree to these Terms.
1. The Service
The Morrow Market is a marketplace that connects local farmers, makers, and producers (“Vendors”) with customers in Morrow County, Ohio and the surrounding area. We facilitate ordering, payment, and coordinated delivery or pickup. The actual products are produced and supplied by the Vendors, not by The Morrow Market.
2. Accounts
- You must be at least 18 years old (or have a parent/guardian's consent) to create an account.
- You agree to provide accurate information and keep it up to date.
- You are responsible for activity under your account and for keeping your password secure.
3. Orders, payment, and pricing
- Prices are listed by Vendors and may change. The price at the time you confirm checkout is the price you pay.
- Payment is processed by Stripe. By placing an order you authorize the charge to your selected payment method.
- Sales tax is collected where applicable.
- Membership pricing, if any, is described on the membership page and may include recurring billing until cancelled.
4. Delivery, pickup, and product availability
Local food is seasonal. We do our best to ensure availability but reserve the right to substitute, refund, or cancel any item that is unavailable at fulfillment. Delivery and pickup windows are estimates; weather, vendor availability, and other factors may affect timing.
5. Refunds & quality
If a product arrives damaged, spoiled, or significantly different from what was advertised, contact us within 48 hours at hello@themorrowmarket.com. We will work with the vendor to issue a refund, replacement, or credit at our discretion.
6. Vendor terms
If you sell products through The Morrow Market, you additionally agree:
- You are responsible for the safety, accurate description, labeling, and legality of your products.
- You must comply with all applicable food safety, cottage food, and licensing laws in Ohio.
- Payouts are processed via Stripe Connect on our standard payout schedule.
- The Morrow Market may charge platform and processing fees as disclosed in your vendor onboarding.
- We may remove listings or suspend accounts that violate these Terms or applicable law.
7. Acceptable use
Don't misuse the Service. That includes (but isn't limited to) attempting to gain unauthorized access, scraping at scale, posting illegal or infringing content, harassing other users, or using the Service in a way that damages or overburdens it.
8. SMS & email communications
By creating an account or placing an order, you consent to receive transactional emails and text messages related to your account, orders, and deliveries. Message and data rates may apply. Reply STOP to any text to unsubscribe. See our Privacy Policy for details.
9. Intellectual property
The Morrow Market name, logo, site design, and original content are our property. Product listings, photos, and descriptions provided by Vendors remain their property; by posting them on the Service, Vendors grant us a license to display and promote them.
10. Disclaimers & limitation of liability
The Service is provided “as is.” To the fullest extent permitted by law, The Morrow Market disclaims all warranties, express or implied, regarding the Service and the products listed by Vendors. Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.
11. Governing law
These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in Morrow County, Ohio.
12. Changes
We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Continued use of the Service after changes means you accept the updated Terms.
